ATELIUM LLC — CONSUMER HEALTH DATA PRIVACY POLICY

This Policy applies to consumer health data as defined by the Washington My Health My Data Act and the Nevada Consumer Health Data Privacy Law. It applies to consumers in Washington and Nevada, and we apply it to everyone.
It sits alongside our general Privacy Policy at atelium.co/legal/privacy. Where they differ as to consumer health data, this Policy controls.

1. What We Mean by Consumer Health Data
Information that identifies your past, present or future physical or mental health status — including, in our case:
- reproductive and fertility information: cycle, conception efforts, pregnancy history, loss, fertility treatment
- hormone and laboratory values you choose to share
- symptoms, conditions and diagnoses you tell us about
- medications and supplements you mention
- any inference we could draw about your health from your behavior
2. What We Actually Collect — and What We Try Not To
We deliberately collect as little health data as possible.

We do not:
- ask program participants for their own health information;
- accept identifiable client information from program participants — cases are submitted anonymized;
- collect health data through cookies, pixels or trackers;
- buy health data from anyone;
- infer health status from browsing behavior.
3. Where It Comes From
Only from you — what you type into a form, write to us, or tell us on a call. We do not obtain consumer health data from data brokers, public records, or other third parties.
4. Why We Use It
- to give you the assessment result, resource or answer you requested;
- to prepare for and conduct a consultation you booked;
- to deliver a coaching service you purchased;
- to keep records we are legally required to keep;
- to protect someone's vital interests in an emergency.
We do not use consumer health data for advertising or marketing, and we do not use it to build advertising audiences or for targeted advertising.
5. Who We Share It With
We do not sell consumer health data. We have never sold it and we do not intend to. Selling it would require your separate, signed authorization on a specific form — which we do not use.
We share it only with service providers bound by contract to process it solely for us:

We may also disclose it where required by law, but we will tell you unless we are legally prohibited.
We do not share consumer health data with advertising platforms, social networks, analytics providers or data brokers.
6. Consent
We collect consumer health data only with your consent — given when you choose to enter it or tell us — and only for the purposes in §4. Consent to collection is separate from consent to share, and neither is bundled into our Terms.
You may withdraw your consent at any time by emailing info@atelium.co. We stop processing on receipt. Withdrawal does not affect what happened before it.
7. Your Rights
You have the right to:
- Confirm whether we hold consumer health data about you;
- Access it, including a list of every third party we shared it with, and contact details for each;
- Withdraw consent to its collection and sharing;
- Delete it — and on a deletion request we will delete it from all of our systems, including backups and archives, and notify every service provider and third party that received it, directing them to do the same.
No account is required to exercise these rights, and we will not discriminate against you for doing so.
How
Email info@atelium.co with the subject line "Health Data Request." Tell us what you want. We respond within 45 days, extendable once by 45 days with notice.
We verify identity using information we already hold. We will not ask you for a government ID or additional health information in order to process a request.
If we say no
You may appeal by replying to our decision. We respond within 45 days. If we deny the appeal, we will give you a link to complain to the Washington State Attorney General at [www.atg.wa.gov/file-complaint](https://www.atg.wa.gov/file-complaint), or your own state's Attorney General.
Washington residents: the My Health My Data Act also gives you a private right of action under the Washington Consumer Protection Act.
8. How Long We Keep It

Or until you ask us to delete it, whichever comes first.
9. How We Protect It
Access-controlled systems; access limited to those who need it; encryption in transit; and a standing instruction internally that consumer health data is never placed in advertising tools, shared spreadsheets, or general-purpose chat.
10. Geofencing
We do not use geofencing around any healthcare facility, fertility clinic, pharmacy or any other location, for any purpose.
11. Changes
We will update the date above and notify you of material changes before they take effect.
